SPED - Transportation Procedures

Procedures for transportation for students receiving special education services.

E.C. 56342 States that it is the responsibility of the I.E.P. team to “consider local transportation policies” during the I.E.P. team meeting. Students receiving special education services are under the same district policy for transportation services as are students receiving only regular education with three exceptions:

1) Students whose needs cannot be met at the school of residence may receive district transportation to the site at which the assigned class is located (Intra-district transfers and inter-district transfers) if the I.E.P. team has marked “yes” on the section addressing special transportation. 

2) Students receiving special education services in a “severely disabled special day class” or “orthopedically impaired pupils who require a vehicle with a wheelchair lift…..as specified in their individualized education program” (E.C. 41850 (d)(1)). The district will only provide transportation if the I.E.P. team has marked “yes” the section addressing special transportation. 

3) Students attending a Non-public school (E.C. 56366 (a)(1)). This only applies if the student is placed at the Non-public school by the district at the I.E.P. meeting and the I.EP. team has marked “yes” in the section denoting special transportation. The district does not provide transportation if the student is unilaterality placed by the parents.

E.C. 56441.14 reads ”Criteria and options for meeting the special education transportation needs of individuals with exceptional needs between the ages of three and five, inclusive, shall be included in the local transportation policy required pursuant to paragraph (5) of subdivision (b) of Section 56195.8”.

The district does not provide transportation to students receiving special education services if the parents have placed the student at a site other than his/her school of attendance.

Students receiving special education services are only provided special transportation if the decision is made during the I.E.P. meeting and indicated in the section addressing transportation. If there is a concern that transportation other than that normally provided to all students may be needed, please contact the Director of Special Education prior to the I.E.P. meeting.
